Welcome to the FieldsIQ Foundation. Please read these Terms of Service ("Terms") carefully before using our website located at fieldsiq.org (the "Site") and our family of educational and troubleshooting mobile applications, including but not limited to K12PRO and NursePRO (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

1. Eligibility and Accounts

Age Requirements: Our Services include educational platforms tailored for kindergarten through grade twelve students (K12PRO). If you are under the age of 18, you must have the permission of a parent or legal guardian to create an account and use the Services.

Account Responsibility: You are entirely responsible for maintaining the confidentiality of your account credentials (managed via secure authentication protocols). You agree to notify us immediately of any unauthorized use of your account.

2. Open-Access and Non-Commercial Use

FieldsIQ Foundation is a registered 501(c)(3) non-profit organization.

License Grant: We grant you a personal, non-exclusive, non-transferable, and revocable license to access and use our adaptive learning engines, math formulas (LaTeX), reasoning paths, and logic diagrams purely for individual, non-commercial educational enrichment or diagnostic reference purposes.

Prohibited Activities: You agree not to:

• Sublicense, sell, rent, or lease any portion of the Services or core datasets.
• Attempt to reverse-engineer, decompile, or bypass the 5-layer JSON Schema validation or multi-model AI routing infrastructure powering the App Factory engine.
• Use automated scripts, bots, or scrapers to extract pedagogical text, hints, reference documents, or logic frameworks generated by our AI platform.

3. Intellectual Property and Content Generation

Our Technology: All software, algorithms, the App Factory core engine, structural designs, schemas, logos, and proprietary data structures are the exclusive property of FieldsIQ Foundation and our technology licensors.

AI-Generated Assets: The dynamic problem-solving pathways, logical flowcharts (Mermaid/SVG), and hints delivered to your device are processed in real-time. These materials are provided "as-is" for learning, tracking, and troubleshooting optimization.

4. No Commercial Transactions (Waiver Policy)

No App Purchases: In strict compliance with global non-profit app distribution frameworks, our core public apps (such as K12PRO and NursePRO) are entirely free to download and contain no hidden commercial subscriptions, paid digital assets, or in-app purchases (IAP).

Third-Party Platforms: Your download and installation of our apps are also subject to the standard user agreements of the Apple App Store and Google Play Store.

5. Disclaimer of Warranties and Limitation of Liability

Educational / Reference Purposes Only: The adaptive hints, formulas, and references provided by our cognitive engine are for learning reinforcement and diagnostic troubleshooting simulation. FieldsIQ Foundation makes no guarantees regarding specific academic grades, passing scores on professional certifications (such as nursing exams), or complete hardware resolution on commercial machinery.

"As-Is" Provision: The Services are provided on an "As-Is" and "As Available" basis without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of our Services, without prior notice, for any conduct that we believe violates these Terms, harms other users, or compromises the security of our cloud infrastructure.

7. Governing Law

These Terms and any dispute arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the United States and the State in which FieldsIQ Foundation is legally incorporated, without regard to its conflict of law principles.
